1) Scope of Application
1.1 These Terms & Conditions (T&C) apply to all contracts for the purchase of digital products (e.g., PDF templates, guides, riddle sets) between the provider Arne Boetel – Individual Entrepreneur (hereinafter “Provider”) and customers (both consumers and businesses).
1.2 A “consumer” is any natural person who purchases a product for purposes not primarily related to their trade, business, or profession.
A “business customer” is any natural or legal person acting in the course of their commercial or professional activity.
1.3 Digital products within the meaning of these T&C are download-based products that are delivered electronically after purchase.
2) Conclusion of Contract
2.1 Product listings in the online shop do not represent a legally binding offer. They are an invitation for the customer to submit a purchase offer.
2.2 A binding purchase offer is submitted when the customer adds products to the cart, completes the order process, and clicks the “Buy” button.
2.3 The Provider accepts the offer either by sending an email confirmation or by immediately providing the download link(s).
2.4 The contract text is stored and can be made available to the customer upon request.
3) Right of Withdrawal
3.1 A withdrawal/cancellation right exists only if the digital product has not yet been downloaded. Consumers generally have a statutory right of withdrawal.
3.2 Exclusion of the right of withdrawal:
The right of withdrawal expires once the customer begins downloading the digital product. This applies because digital content is delivered instantly and cannot be returned.
To proceed with the download before the withdrawal period ends, the customer must explicitly agree to the immediate provision of digital content and acknowledge that doing so waives their withdrawal right.
4) Prices and Payment
4.1 All prices shown in the shop are final prices and include applicable taxes, where required by law.
4.2 Payments are made using the payment methods offered during checkout.
4.3 Digital products are only made available after full payment has been received.
5) Delivery & Access to Digital Content
5.1 Digital content is provided via immediate download once payment is completed.
5.2 After purchase, the customer receives an email confirmation containing the download link(s).
5.3 Delivery via other means is not possible.
Customers are responsible for downloading and securely storing the files after purchase.
6) License & Usage Rights
6.1 Upon purchase, the customer receives a simple, non-transferable license to use the digital product.
6.2 Usage is strictly limited to personal, private, non-commercial purposes.
6.3 Prohibited actions include:
-
Sharing files with third parties
-
Selling, renting, or distributing the files
-
Publishing or making the products publicly accessible
6.4 Any violation may result in legal action.
7) Warranty & Liability
7.1 Statutory warranty rights apply.
7.2 If a file is defective or cannot be downloaded, the customer is entitled to request a corrected version.
7.3 The Provider is not liable for damage arising from improper use, incompatibility with devices/software, or technical issues outside the Provider’s control.
8) Promotional Codes
8.1 Promotional codes are not available for purchase and may only be redeemed during the specified validity period.
8.2 Promotional codes must be entered before completing the order. Retroactive application is not possible.
9) Applicable Law
9.1 The law of Georgia applies.
9.2 This choice of law shall not deprive consumers of mandatory consumer protection rights applicable in the country where they reside.
10) Alternative Dispute Resolution
10.1 The European Commission provides an online dispute resolution (ODR) platform:
https://ec.europa.eu/consumers/odr
10.2 The Provider is not obligated to participate in consumer arbitration procedures, nor does the Provider voluntarily participate in such proceedings.
